事实上的确不等于身份取消
这条新闻的最后提到了：
“Mr. Patel is lawfully present in the U.S.,” Andre Watson of the Department of Homeland Security said. “He is not subject to immediate detention or removal.”
这是否意味着DHS的官方官员承认了SEVIS terminate之后的人依然是在美国合法居留？不知道这个在未来的法律争端中算不算可以引用的论据。

事实上取消SEVIS的确不等于取消了F-1 visa，所以之前官司中法官才问SEVIS terminate之后的人的status是甚麽。
至于为什么terminate国际学生的SEVIS，目前没人知道

所以说，Visa, SEVIS以及Status其实是三个不同的东西？
理论上，Visa跟SEVIS是完全不同的东西。
USCIS说得很清楚，SEVIS就是个information system。
SEVIS is a web-based system for maintaining information on nonimmigrant students and exchange visitors in the United States. It is the core technology for the DHS in this critical mission. SEVIS implements Section 641 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, which requires DHS to collect current information from nonimmigrant students and exchange visitors continually during their course of stay in the United States.

Non-Immigrant Visa

The CBP Officer at the port-of-entry will conduct an inspection to determine if the individual is eligible for admission under U.S. immigration law.

红码没有法律意义，上海没有封城过，都是居委会自愿自发行为。SEVIS Terminate没有法律意义，被terminate的人有合法status，学校不敢给他们发钱都是学校自发行为？
很多学校的很多职位是不能e verify的（比如所有不能雇OPT STEM Extension的职位），所以对于这其中的私校而言，在这次termination事件中不敢雇没有status的人确实是自发行为

所以I-94才是逗留的法理依据，那I-94上面的D/S要追溯哪个文件？

USCIS AFM policy，在 USCIS 在审理案件中裁定 fail to maintain status，或者移民法庭裁定，的第二天开始计算 unlawful presence
换而言之，就算毕业了就赖着不走了，只要没被书面裁决，都不算 unlawful presence。至于 fail to maintain，从实质上发生了违反行为的那天计算
