上周四出了cash offer,周五agent说I won the bid,当天status of property 变成“Pending". 提供了cashier’s check for earnest money和bank statement. 这周一,突然agent 发消息说 listing agent搞错了,这个HUD房子在我之前一个bidder的报价已将被接受了。 现在已经投诉到HUD和州里的Real Estate Commission. 还有别的什么方法渠道可以撕吗。

没有,agent 要的是picture of cashier’ check,因为purchase agreement还没签。

细节太少了。为什么没有接受。出了什么事情。agent干了什么事。这肯定要更多细节
另外mutual agreement都没签并不算接受。 合同要签字执行了才算有效。你这字没签。check没存。啥也没用啊
那你没有case 说实话这种事情太多了,书面的接受offer的正式文件你也没有吧
我的offer被接受了啊(上周五)。。现在是 my winning bid rescinded(这周一)… 说是listing agent 搞错了 -在我之前有个bidder的bid已经被接收了。 这可能只是搞错了吗。。。我觉的是 bidding process was rigged…过着buyer’s agent, 或者listing agent… 或者他们两个合伙。。。 在接收了我的bid之后,有人出了更高价格。。
有 agent的 text message说我赢了bid…
"被接受“指的是mutual agreement 的合同签字 并且执行。text message没有用。只能说你找律师的话 都不一定有人接。
今早agent发来邮件解释。。I wanted to show you my email thread with the asset manager - I went in and canceled the bid they had accepted because yours was higher and I thought they had made a mistake.
They uncancelled the bid I cancelled and said that they had accepted the other parties bid (put in Feb 1st but then countered by HUD and not accepted by the buyers but the buyers bid was held as a backup) They called me as a response and said that I must have submitted the bid in the small window between their acceptance and the property becoming unavailable to bid on and that we had to give the first party the chance to follow through with their original bid before they could consider yours.

根本说不通 怀疑这些agent不懂HUD房子拍卖程序。
怎么说不通?agent的bid根本就没有被hud接受。asset manager写得很明白了,他发现没有能力cancel一个之前已经被接受的bid。你的bid甚至都不是第二顺位。
我做了如下回复。并抄送了HUD和州Real Estate Commission。。有什么需要补充的马。。

I respectfully request that you and HUD investigate this mishandling of HUD bidding process and reinstate my winning bid.
信很有气势,但没有依据。是不是要列出来他们哪一条没做到啊?看上去你熟读hud bidding procedure。那么你想让他们遵守第几页第几条啊

话说人家没签字也可以撤回. 不卖给你你也没辙.
没用的,另外一家在你的bid之前就被接受了。。。HUD不透明,规矩很多,基本没有希望overwirte的。move on,找下个deal吧
反过来想, 如果你是卖家, 你没签字, 不就是想看看还有没有更高的offer么?

这个是HUD, 相比价格,程序更重要。。。

你说的和你发的信不一致。
asset manager传达的是hud做决定之后才收到你的bid,所以你的bid没有被接受。
我的贴子没有提及。。。但是我的offer是最高的。。是agent告诉我的。。。卖给我是最合适的。。
